BU pension limited in time, reduced or stopped
Even if you are already receiving benefits, you are not safe: insurers limit their acknowledgements in time and stop payments after a reassessment. This can be reviewed.
Time-limited acknowledgement
Under certain conditions, the insurer may acknowledge its obligation to pay benefits once for a limited period and must give reasons for the time limit (§ 173 VVG). When the period expires, payments end unless you submit a new application in good time. Whether the time limit was permissible and how you should proceed afterwards depends on your policy terms.
Reassessment and termination
The insurer may check whether your state of health or its effects on your occupation have changed. It must set out the change in a clear and comprehensible way and notify you of its decision in text form. Its obligation to pay benefits then ends at the earliest at the end of the third month after you received the notification (§ 174 VVG).
- Is the alleged improvement medically documented?
- Was the comparison with the situation at the time of the acknowledgement made properly?
- Are you being wrongly referred to a different occupation?
- Were the form and deadlines for the notification complied with?
Do not sit back: After payments are stopped, the insurer pays at the earliest until the end of the third month after you received the notification (§ 174 VVG). Have the decision reviewed during this time so that there is no gap in your pension. Your claim itself becomes time-barred after three years.
How we proceed
We review the notification, the medical reports and the basis of comparison, request documents and clarify whether an objection, negotiation or legal action is the right course. We cannot give any assurance as to the outcome.
