Why insurers reject claims

Common reasons, and why they are not the final word

Breach of the duty of disclosure

The insurer claims that you concealed pre-existing conditions. Often the questions were unclear or have been interpreted incorrectly.

“Not disabled enough”

Disputes about the degree of occupational disability, medical reports or the description of the work you actually do.

Referral to another occupation

The insurer refers you to a different occupation (Verweisung). Whether this is permitted under your policy terms can be reviewed.

Reassessment and time limits

Benefits are stopped or limited in time. The insurer must provide clear, comprehensible evidence of the change.

How it works

  1. Send your enquiry

Fill in the check and, if possible, upload your documents. It only takes a few minutes.

  2. Free initial review

We review your documents and tell you honestly whether, and to what extent, we see prospects of success.

  3. Decide together

You decide whether we represent you. We clarify the costs and your legal expenses cover in advance.

Jonas Kainzinger, Rechtsanwalt (German lawyer), represents policyholders against their occupational disability insurers. Frequently asked questions

Answers to the most important questions

How much does the initial review cost?

The initial review of your documents and your prospects of success is free of charge and without obligation. We tell you in advance whether representation would involve any costs and, if so, which. If you have legal expenses insurance, we clarify the cover for you.

My BU insurer has rejected my application. Do I have to accept that?

No. A rejection is not the final word. Many decisions are based on medical reports, interpretations of health questions or policy terms that can be reviewed. Whether your case has a prospect of success depends on the details. That is what we review.

How quickly do I need to act?

There is no longer a fixed deadline for bringing a claim to court after a rejection. However, your claim becomes time-barred after three years, usually counted from receipt of the rejection. Our deadline calculator gives you a guide. Please get in touch as early as possible all the same, especially before you give the insurer any further information. Every month without your pension costs you money.

The insurer accuses me of breaching my pre-contractual duty of disclosure. What now?

Withdrawal from the contract (Rücktritt) and rescission (Anfechtung) on the grounds of allegedly incorrect health information are a frequent point of dispute. What matters is how the questions were worded, what you stated and what the insurer should have asked. Do not sign anything or answer any further questions without taking advice first.

Which documents do I need for the initial review?

Helpful documents are the letter rejecting or reducing your benefits, the insurance policy with its terms and conditions, the application and medical reports. If something is missing, please get in touch anyway. We will tell you what else we need. You can upload everything easily and in encrypted form via the form.

Are my data and documents safe?

Your documents are transmitted in encrypted form and stored in non-public storage in the EU. Only we have access. We treat your information confidentially and are bound by lawyer–client confidentiality.

Does the check replace legal advice?

No. The check gives you an initial orientation based on the information you provide. A binding assessment is only possible once a lawyer has reviewed your documents. A lawyer–client relationship (Mandat) is only established once we have expressly confirmed it.
